Proposed Waikato District Plan – Decision Notification Ohinewai Rezoning and Development – Sleepyhead Estate (Submission by Ambury Properties Limited)

Pursuant to clauses 10(4)(b) and 11 of Schedule 1 of the Resource Management Act 1991 (“RMA”), Waikato District Council gives notice that on 24 May 2021 the Independent Hearings Panel made its decision on the provisions and matters raised in submission No. 764 by Ambury Properties Limited (“the APL Submission”) and further submissions on the APL Submission relating to the Ohinewai Rezoning and Development (“Decision”) in the Proposed Waikato District Plan (“PDP”).

All persons who made a submission on the PDP have been sent a notice of the Decision pursuant to clause 11 of Schedule 1 of the RMA.

Decisions on the other submissions which sought rezoning at Ohinewai in the PDP, including further submissions on those submissions, will be incorporated and released in the remaining decisions on the PDP (“Full Decisions”). Waikato District Council will give notice to all submitters on the PDP when the Full Decisions are made.     

Inspection and availability of the Decision

The Decision version of the PDP provisions on the Ohinewai Rezoning and Development relating to the APL Submission and related further submissions is available for public inspection online at waikatodistrict.govt.nz/ohinewai-rezoning-decision and in Waikato District Council offices and libraries as of 12 noon 24 May 2021. A copy of the Decision is also available upon request.

Appeals to the Environment Court

Ambury Properties Limited and any person who made a further submission on the APL Submission relating to the Ohinewai Rezoning and Development in the PDP may appeal to the Environment Court in accordance with clause 14 of Schedule 1 of the RMA.

Any appeal must be in the prescribed form, lodged with the Environment Court and served on Waikato District Council within 30 working days of service of the Notice of Decision. Within 5 working days of lodging an appeal, you are required to serve a copy of your appeal on every person who made a submission on those provisions or matters to which your appeal relates.
