Proposed Waikato District Plan – Decision Notification

Pursuant to clauses 10(4)(b) and 11 of Schedule 1 of the Resource Management Act 1991 (“RMA”), Waikato District Council (“Council”) gives notice that on 17 January 2022 the Independent Hearings Panel made its Decision on the provisions and matters raised in submissions and further submissions to Stages 1 and 2 of the Proposed Waikato District Plan (“PDP”).

This Decision concerns all parts of the PDP except for the decisions on the:

  1. Raglan Landward Navigation Beacon, which was notified on 31 July 2020; and
  2. Ohinewai Rezoning and Development provisions relating to submission no. 764 by Ambury Properties Limited and further submissions on that submission, which was notified on 24 May 2021.

The date of this Decision complies with the Minister for the Environment’s extension of time for giving a decision on the PDP under clause 10, which was granted on 21 September 2021.

All persons who made a submission on the PDP have been sent a notice of the Decision pursuant to clause 11 of Schedule 1 of the RMA.

Inspection and availability of the Decision

The Decision version of the PDP provisions is available for public inspection online at https://www.waikatodistrict.govt.nz/your-council/plans-policies-and-bylaws/plans/waikato-district-plan/district-plan-review/decisions/proposed-waikato-district-plan from 11am on 17 January 2022. An online version can also be viewed in Waikato District Council’s offices and/or libraries from 17 January 2022.

Appeals to the Environment Court

Any person who made a submission or further submission on the PDP may appeal to the Environment Court in accordance with clause 14 of Schedule 1 of the RMA.

Any appeal must be in the prescribed form, lodged with the Environment Court and served on Waikato District Council within 30 working days of service of the Notice of Decision. Within 5 working days of lodging an appeal, you are required to serve a copy of your appeal on every person who made a submission on those provisions or matters to which your appeal relates.

This notice is given under Clause 10(4)(b) of Schedule 1 of the RMA on 17 January 2022.
