Code Compliance Certificate

The Code Compliance Certificate (CCC) confirms that the completed building work has been built in accordance with the approved building consent documents and complies with the Building Code. A CCC is issued by the Building Consent Authority (BCA) in accordance with s.95.

Obtaining a CCC is very important as sale and purchase contracts are often conditional on a CCC being issued and the deciding factor in the sale and purchase of a property. Not having a CCC may also affect your household insurance.

We recommend that you get a final inspection completed prior to applying for a CCC.

The application documentation can be submitted by email, mail, or over the front counter at any Council office

The following documents MUST be included with the application for CCC:

  • Any energy certificates (electrical and /or gas) otherwise Council can refuse to issue a Code Compliance Certificate under s94 (3) of the Building Act 2004
  • All records of work if the project involved restricted building work. These MUST be supplied when the CCC is applied for otherwise the Council could refuse to accept the application. (s92 of the Building Act 2004)
  • If the building work includes the use of a modular component a current manufacturer’s certificate for that component
  • If development contributions are required, make sure that these are paid otherwise Council can refuse to issue a CCC
  • Pay any fees and charges imposed by the building consent authority under section 219 or 240(as applicable).

Complete the CCC application form (Form 6). Please ensure details such as date construction completed, tradespeople and LBPs names and details are provided, and the form is signed.  If the project involves specified systems additional information is required to confirm they are operational and installed in accordance with the performance standards listed on the building consent.

The application must be made by the owner as soon as possible after the project has been completed. In addition to the above information, supply all third-party certification paperwork as listed on your Building Consent (Form 5) e.g. producer statements, as-built plumbing / drainage plans, specified system installation / certification certificates (if relevant). 

We will check that the application form is completed in full and supported with the appropriate documentation.  If not, the application will not be accepted (we will explain the reasons why it has been declined).

If the application is accepted, we will start the 20-day clock.  We have 20-working days to process the application and either issue or refuse the CCC.  We may request further information during this process. If we do, then the clock will stop until such time as the information is provided.

The BCA will issue the Code Compliance Certificate if it is satisfied, on reasonable grounds, that the building work complies with the building consent and Building Code; and that: 

  • in a case where a compliance schedule is required because of the building work, the specified systems in the building can perform to the performance standards set out in the building consent; or
  • in a case where an amendment to an existing compliance schedule is required because of the building work, the specified systems that are being altered in, or added to, the building during the building work can perform to the performance standards set out in the building consent.

If the project is a commercial building with specified systems, the Compliance Schedule will be issued on the same day as the Code Compliance Certificate.

If there are any outstanding fees, these must be paid before the CCC will be issued.
