A Notice to Fix is issued under Section 164 of the Building Act. The notice is in general issued for contravening or failing to comply with the Building Act or the Regulations. (For example failing to obtain a building consent; failing to restrict access to a residential pool; failing to provide a Building Warrant of Fitness)

The notice states a timeframe to address the non-compliance and failure to comply with the Notice will result in a further Notice being issued and an Infringement Notice and fine.
